Caffeine pouches: age and legal status in Germany

Energy pouches are often confused with nicotine pouches when discussing age and legal status. Contents, product requirements and the destination market matter.

At a glance

This magazine is for adults. Retailer rules and manufacturer recommendations differ from statutory age limits. EFSA’s 200 mg caffeine assessment is not a blanket statutory product limit.

At what age: 16 or 18?

Section 10 of Germany’s Youth Protection Act covers the tobacco, nicotine and other products specified there. Pouch shape alone does not establish a universal age limit for every nicotine-free caffeine pouch. A retailer’s “16+” policy is likewise not automatically legislation.

Manufacturers and retailers may state their own age policies. This magazine is for adults and does not recommend use by children or teenagers. Questions about age 14, 16 or use at school are addressed as clarification, not encouragement to consume.

Format alone does not decide this. A nicotine-free product must be considered in relation to food safety, ingredients, labelling and permitted claims. An online listing does not establish official approval or blanket marketability of every formulation.

The Bavarian LGL assesses oral pouches by their contents and also reports labelling issues in nicotine-free products. Read supplier details and complete product information before buying.

Are 300 mg per pouch automatically prohibited?

The commonly cited 200 mg comes from EFSA’s assessment of single caffeine intake in healthy adults. It is not a universal statutory maximum for every caffeine pouch. The BfR describes no general binding maximum quantities for supplement ingredients; food safety and product-specific requirements still apply.

300 mg exceeds that scientific single-dose reference. We do not turn this into either a recommendation or a blanket legal conclusion. No 300 mg pouches are included in our dated checked product snapshot. Do not exceed the product’s serving directions.

Nicotine is a separate product question

Nicotine pouches contain nicotine even when tobacco-free. The LGL explains that nicotine lacks authorisation as a novel food ingredient and foods with added nicotine are not marketable on that basis. Similar shape does not turn these into nicotine-free energy products.

For searches such as nicotine pouches with caffeine, we distinguish the terms: this site covers energy pouches without nicotine. People who do not use nicotine should not start. Other pouch formats include nicotine-free and caffeine-free variants.

Before buying: choose clear information

Look for caffeine per pouch, ingredients, the responsible business and manufacturer directions. EnergyPouches.shop offers different brands and strengths to compare. Product information supports an informed choice and does not replace assessment of an individual legal situation.

Orders to Switzerland or other countries are subject to their own import and product requirements. Check delivery countries and shipping terms with the retailer; website language does not determine them.

Common questions

Is a manufacturer’s age recommendation a legal age limit?

No. Recommendations, voluntary retailer policies and legal requirements must be identified separately.

Is 200 mg a statutory maximum per pouch?

The EFSA assessment is a scientific safety reference, not a blanket statutory product limit.
